In Spain, the term “okupas” refers to individuals who illegally occupy empty properties without the owner’s permission. This practice is linked to the Okupa movement, which began as a political housing protest but now often involves organized squatting in vacant homes.
The illegal occupation of property, known in Spain as “okupación”, has long been a concern for homeowners and international investors.
I spoke with clients who live in Germany and only visit the Costa del Sol for vacation. They watched a lot of terrible news about property occupations on some of the main Spanish media outlets.
Keep in mind that these reports are propaganda intended to show what happens after a court victory and the police arrive. Many media outlets in Germany and Spain show police forces in action. So, these were their first questions: “What is the situation with okupas?” We’ve heard terrible stories about them.
However, recent legal reforms have dramatically strengthened property rights and expedited eviction procedures.
With the introduction of Organic Law 1/2025, Spain now has one of the fastest legal responses to illegal occupation in Europe. This law allows authorities to remove squatters within days rather than months.
The reform aims to protect homeowners, restore confidence in the rental market, and deter organized squatting groups.

Stronger Legal Protection for Property Owners
The Anti-Okupa reform, introduced in 2025, significantly simplifies and accelerates the eviction process for illegal occupants without a rental contract or legal right to occupy a property.
Key protections include:
- Fast police intervention: If squatters are detected within the first 24–48 hours, the police can remove them immediately, bypassing the need for a lengthy court procedure.
- Express court eviction: When the case goes through the courts, eviction can be ordered in approximately 15 days, compared to many months under previous legislation.
- No “vulnerability” delays: Economic hardship claims can no longer be used to block eviction in cases of illegal break-ins or usurpation.
- Stronger criminal penalties: Organized squatting networks and repeat offenders face heavier fines and potential prison sentences.
- Simplified proof of ownership: Owners only need to present a property title or deed to start eviction proceedings.
These changes send a clear message that Spain is strengthening the protection of private property.
What Property Owners Should Do
Although the law now offers more protection, prevention remains the best strategy.
Property owners are advised to:
- Report any occupation to the local police immediately.
- Keep property documentation accessible, such as title deeds and identification.
- Install alarm systems or monitored security.
- Ask neighbors or community managers to monitor vacant homes.
- Maintain regular activity or a presence in the property.
If action is taken quickly, the new legislation allows authorities to intervene extremely fast, preventing long legal disputes.
It is also important to note that the fast-track procedure mainly applies to illegal break-ins, not cases in which tenants stop paying rent (“inquiokupas”), which are handled under civil eviction procedures.

Why the Risk on the Costa del Sol Is Generally Low
Despite the media attention surrounding squatting, the actual risk to property owners in prime areas of the Costa del Sol remains relatively low, especially for international buyers.
There are several reasons for this:
- Secure residential developments: Many properties are located in gated communities with security, concierge services, and surveillance systems, which makes illegal occupation extremely difficult.
- Active communities: Residents and neighbors typically monitor unusual activity, which prevents squatters from remaining unnoticed.
- Property Profile: Okupas tend to target abandoned or long-vacant apartments in large urban areas where anonymity is easier to achieve.
- Cities such as Barcelona and Madrid have historically experienced higher rates of illegal occupation.
- Higher-value neighborhoods: Prime coastal areas like Марбея, Бенахавис, Естепона, и Сотогранде have stronger property management, community security, and regular property maintenance.
For these reasons, property owners in the Costa del Sol benefit from both legal protection and physical security infrastructure.
A Positive Signal for Property Investors
The new anti-occupation measures demonstrate Spain’s commitment to protecting property rights and maintaining investor confidence.
For international buyers and property investors, the reform means:

Conclusion: Why is Okupa not a factor for us?
Given the types of properties we represent and the areas in which we operate on the Costa del Sol, the risk of illegal occupation is extremely low.

In my time in the industry, I haven’t heard of or seen any okupa cases in my environment. Trust me, I’ve met many owners, buyers, agents, agencies, and developers. If it were a common concern, people would gossip about it. That’s not the case here.
In practice, the risk is often overstated and is comparable to other everyday uncertainties — something that can happen, but is highly unlikely for well-managed properties in prime locations.
