2. Scope of Services
Costa Prime Realty provides:
- Property marketing and listing services
- Buyer advisory services
- Property sourcing
- Negotiation support
- Coordination with legal, financial, and notarial professionals
- Co-brokering with partner agencies
We act solely as an intermediary unless otherwise agreed in writing.
3. Nature of Listings
All property listings:
- Are based on information provided by sellers, developers, or third parties
- Are subject to availability and prior sale
- May change in price, status, or specifications without prior notice
While we make reasonable efforts to verify accuracy, we do not guarantee completeness or correctness of listing information.
Buyers are responsible for conducting independent due diligence.
4. Prices and Costs
Property prices:
- Are displayed in Euros (€) unless stated otherwise
- May not include applicable taxes, notary fees, registry costs, legal fees, or financing costs
Typical additional purchase costs in Andalusia:
- Resale properties: approx. 8–10%
- New developments: approx. 10–13%
These percentages are indicative only and subject to change under Spanish law.
5. Offers and Reservations
All offers:
- Must be submitted in writing
- Are subject to seller acceptance
- Do not constitute a binding agreement until formal documentation is executed
Reservation contracts and private purchase contracts (Contrato de Arras) are legally binding once signed.
Costa Prime Realty is not responsible for contractual disputes between buyer and seller.
6. Seller Obligations
Sellers agree to:
- Provide accurate and lawful property information
- Disclose known defects, encumbrances, or legal limitations
- Provide valid ownership documentation
- Comply with Spanish property and tax laws
Costa Prime Realty reserves the right to remove listings containing misleading or inaccurate information.
7. Buyer Responsibilities
Buyers are responsible for:
- Obtaining independent legal advice
- Securing financing if required
- Conducting technical inspections
- Verifying planning and zoning compliance
- Reviewing contracts before signing
Costa Prime Realty does not provide legal, tax, or financial advice unless explicitly agreed in writing.
8. Commission and Agency Relationships
Commission structures are defined separately in listing agreements or buyer representation agreements.
Unless otherwise stated:
- Commission is payable upon successful completion at notary
- Commission arrangements with partner agencies are governed by co-broker agreements
Unauthorized circumvention of the agency (direct negotiation after introduction) may result in commission claims under Spanish civil law.
9. Partner Agencies & Co-Brokering
Costa Prime Realty may cooperate with:
- Local agencies
- International brokers
- Developers
In co-broker transactions:
- Commission is shared as agreed
- Each agency remains independently responsible for its own regulatory compliance
10. Anti-Money Laundering Compliance
In accordance with Spanish Law 10/2010:
- Identity verification is mandatory
- Documentation may be retained as legally required
- Transactions may be reported to authorities where required
Failure to provide required documentation may result in termination of services.
11. Intellectual Property
All website content, including:
- Text
- Branding
- Logos
- Property descriptions
- Images (where owned or licensed)
is protected under intellectual property laws.
Reproduction without written consent is prohibited.
12. Website Use
Users agree not to:
- Misuse content
- Scrape property data
- Copy listings
- Submit false inquiries
- Attempt unauthorized access
We reserve the right to restrict access for abusive behavior.
13. Limitation of Liability

- Delays caused by notaries, banks, or public authorities

We are not liable for failure to perform obligations due to events beyond reasonable control, including:

16. Governing Law and Jurisdiction
These Terms & Conditions are governed by:
